These Terms and Conditions govern your use of the Bio Breath Solutions website (bio-breath.com.au) and the purchase of products from Bio Breath Solutions Pty Ltd (ACN 684 751 399) ("Bio Breath Solutions", "we", "us", "our").
By placing an order or using this website, you agree to these Terms. If you do not agree, do not use this website or place an order.
Bio Breath Solutions manufactures and supplies biodegradable breathalyser mouthpieces certified compostable under EN 13432 (DIN CERTCO Registration No. 7W0664). Our products are compatible with Alcolizer HH3, HH4, and LE5 devices and have been independently tested by Vipac Engineers and Scientists (NATA-accredited laboratory) in accordance with AS 3547:2019.
Product specifications, certifications, and compatibility information are provided in good faith and are accurate to the best of our knowledge at the time of publication. We reserve the right to update product specifications without notice.
All orders are subject to acceptance by Bio Breath Solutions. We reserve the right to refuse or cancel any order at our discretion, including where products are unavailable, where an error has occurred in pricing or product description, or where we suspect fraudulent activity.
Once an order is confirmed, you will receive written confirmation by email. This confirmation constitutes our acceptance of your order and forms a binding agreement between you and Bio Breath Solutions.
All prices are listed in Australian dollars (AUD) and are exclusive of GST unless otherwise stated. GST will be added at checkout where applicable.
We reserve the right to change pricing at any time without notice. Price changes will not affect orders that have already been confirmed in writing.
Full payment is required before your order is processed and dispatched. We accept payment by bank transfer (EFT) and other methods as advised at the time of order.
Where payment is not received within 7 days of order confirmation, Bio Breath Solutions reserves the right to cancel the order.
For established accounts, alternative payment arrangements may be agreed in writing. Any agreed credit terms must be confirmed in writing by a Director of Bio Breath Solutions before goods are dispatched.
We will endeavour to dispatch orders within the timeframe agreed at the time of order confirmation. Delivery timeframes are estimates only and are not guaranteed.
Risk of loss or damage to products passes to you upon dispatch. Bio Breath Solutions is not liable for delays caused by third-party couriers or circumstances outside our control.
Delivery costs will be advised at the time of order and are the responsibility of the purchaser unless otherwise agreed in writing.
Due to the consumable and hygiene-sensitive nature of our products, we do not accept returns or provide refunds for change of mind or incorrect ordering.
Returns are accepted only where products are demonstrably defective or damaged upon delivery. To initiate a return, you must notify us in writing at dylan@bio-breath.com.au within 7 days of receiving the goods, providing a description of the defect and photographic evidence where possible.
Where a return is accepted, we will replace the defective product or issue a credit at our discretion. We do not accept returns of products that have been used, stored incorrectly, or tampered with.
All content on bio-breath.com.au, including text, images, logos, graphics, and product descriptions, is the property of Bio Breath Solutions Pty Ltd and is protected by Australian copyright law.
You may not reproduce, distribute, or use any content from this website without prior written permission from Bio Breath Solutions.
To the maximum extent permitted by law, Bio Breath Solutions' liability to you for any loss or damage arising from your use of our products or website is limited to the purchase price of the goods giving rise to the claim.
Bio Breath Solutions is not liable for any indirect, incidental, consequential, or special damages, including loss of profit or revenue, arising from use of our products or website.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law.
Our products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
We collect and handle personal information in accordance with our Privacy Policy, available at bio-breath.com.au/privacy-policy. By using this website or placing an order, you consent to the collection and use of your information as described in our Privacy Policy.
These Terms are governed by the laws of Western Australia, Australia. Any disputes arising from these Terms or your use of our products will be subject to the exclusive jurisdiction of the courts of Western Australia.
We reserve the right to update these Terms at any time. Updated Terms will be posted on this page with a revised date. Your continued use of this website or placement of orders after any changes constitutes your acceptance of the updated Terms.
